Should your expression of interest (EOI) to attend the Event is successful, you are required to sign and return a letter of acceptance issued by Destination NSW. The letter must be returned within 5 working days of your receipt of the letter, failing which Destination NSW will have the right to withdraw this invitation and you may not be able to exhibit at the Event. Destination NSW will also have the right to immediately withdraw this invitation if you are found to be in breach of the terms outlined below.
If you accept the invitation to exhibit, Destination NSW will provide you with the inclusions outlined in the specific opportunity prospectus. These inclusions will be listed in your letter of acceptance.
Any reference to ‘you’ below means you, and any of your employees, workers, sub-contractors, partners, agents or affiliates.
Transfer
You acknowledge that no part of your involvement in the Event is transferable to any other person and cannot be redeemed or exchanged in any manner. You can only represent the organisation named above in its own right unless you have Destination NSW’s prior written approval.
Intellectual property
Destination NSW grants you a revocable, non-exclusive, non-transferable, royalty-free licence to use certain Destination NSW logo(s), images and footage in connection with the Event. Any additional use of the logo(s) may only be used with prior consent from Destination NSW. Any Intellectual Property created, produced or developed as a result of your participation in the Event will vest absolutely in and will remain the sole and exclusive property of Destination NSW. You further grant Destination NSW a revocable, non-exclusive, non-transferable, royalty-free licence to use your logo(s) in connection with the Event.
Insurance
You must provide a copy of your valid certificate of currency for public liability insurance (minimum $20,000,000) noting DNSW as an interested party and valid for the Event period to: conferencing@dnsw.com.au
Use of your image
You acknowledge and agree that Destination NSW may take photos and/or recordings of you throughout your participation in the Event, and that DNSW, its partners and affiliates may use the photos or recordings for future promotional and marketing purposes without further reference or compensation to you. Your image will also be archived with Destination NSW and may be used by Destination NSW and partners for the promotion of future events.
Indemnity
You must also indemnify Destination NSW against any loss, action, proceeding, demand, prosecution, judgment, damage, cost, expense, fine, penalty or liability claimed against or incurred by Destination NSW arising out of any action by you, or personnel engaged on your behalf to exhibit in the Event, or any breach by you or your personnel of these terms and conditions. DNSW includes its subcontractors, officers and employees. All participants are advised that all valuables should not be left unattended or unsecured at any time. Destination NSW accepts no responsibility for any loss or damage suffered you or your employees, workers, sub-contractors, partners, agents or affiliates.
Privacy
The applicable laws are the laws of New South Wales.Any dispute hereunder will be subject to the exclusive jurisdiction of the courts of New South Wales. You and DNSW must comply with all applicable laws in relation to the event including but not limited to the Privacy Act 1988 (Cth) and Privacy and the Personal Information Protection Act 1998 (NSW).
Public comment
Unless otherwise agreed in writing by DNSW, you must not engage in any public comment or communication (including comments on radio and television or to a journalist, social media, digital platforms, views expressed in letters to newspapers or in books, journals and notices) concerning the Event and your engagement with us, or issue any public statement or communication or make any representation that in any way directly or indirectly affects DNSW or our affairs.Under no circumstances are there to be any media announcements (including exclusives) or information shared with media without DNSW’s express approval. Furthermore, there are to be no media or press releases to be issued, including those under embargo, nor any pre briefing of any media unless expressly agreed by DNSW in writing. This excludes comments at the Event.
General
Any costs associated with the opportunity including your time, travel and accommodation are at your own expense (wholly). Any product or service provided for experience by the clients at the event is also at your own expense.
You must ensure that your actions do not bring DNSW into disrepute.
